File audit and past adviser reviews

File audits and past adviser reviews may arise when firms identify an issue with the advice an adviser may have given historically. For example, this might be prompted by a large number of upheld consumer complaints against one or more advisers. We are able to help firms with such reviews with the following services:

  • file check and audit on the sales procedures and processes, proposing remedial actions for past adviser reviews where necessary;
  • any redress / compensation calculations arising from the file review eg where incorrect or inadequate advice was given to consumers to transfer their occupational pension rights to a personal pension policy; and
  • we can provide a Skilled Person Report as and when one is required by the FSA. Section 166 of the Financial Services and Markets Act 2000 gives the FSA power to require firms to provide reports prepared by Skilled Persons. We offer a cost-effective service which is particularly suitable for:

  • small and medium sized companies who do not have the resources, or experience, in dealing with the complexity of past adviser reviews; and
  • large companies who can no longer justify in terms of cost-effectiveness to maintain the infrastructure and capability to deal with these reviews.
