Pensions on divorce

With many years of experience in all aspects and types of pension arrangements, OAC’s actuaries are ideally placed to provide expert advice and reports on the pensions aspects of legal settlements.

Even in amicable divorce proceedings, special consideration needs to be given to ensure a fair settlement involving pensions. In particular, cases involving:

  • public sector employees;
  • employees with prospective retirement ages below the state retirement age eg Police, Firefighters, and Armed Forces;
  • directors and members of executive pension arrangements;
  • members of SSAS schemes;
  • individuals who hold SIPPs;
  • individuals with long service and scheme membership;
  • couples where the female is more than 3 years younger than the male;
  • one of the parties being already retired; and
  • an inequity of state pension entitlements.

We offer a full research, valuation and report service, tailored to each individual case, acting on either single or joint instructions. We can produce reports to meet CPR35, if required for use in Court and, if necessary, we can appear in Court to give evidence.

Fees are case specific and depend upon the complexity involved. Normally structured on an hourly basis we will usually quote after an initial appraisal of the case for which there is no charge. Minimum fees are £500 with average costs being in the region £800 - £1,000.
